1. Agreement and eligibility
By installing, purchasing or using a Mogibo product, you agree to these Terms on behalf of yourself and the business you represent. You confirm that you have authority to bind that business and can lawfully use the service.
If product-specific terms conflict with these general Terms, the product-specific terms control for that product.
2. Accounts, platforms and access
You are responsible for your platform account, authorized users and instructions sent through it. Shopify apps are installed, authenticated and removed through Shopify. Your use of Shopify remains subject to Shopify’s own agreements.
Keep credentials confidential and notify us promptly if you reasonably suspect unauthorized access to a Mogibo service.
3. Fees, trials and beta services
Current prices, trial periods and billing intervals are shown on the applicable listing or purchase screen. Shopify app charges are authorized and managed through Shopify’s billing system. Taxes may apply.
A product identified as beta, preview or in development may change, be incomplete or experience interruptions. We will not describe a beta as production-ready until its stated release checks are complete. Unless a paid plan states otherwise, beta access may be modified or ended with reasonable notice.
4. Acceptable use
You may not use a Mogibo service to:
- Break applicable law or another person’s rights.
- Probe, bypass or interfere with security or access controls.
- Transmit malware or use the service to harm a platform or person.
- Resell, copy or reverse engineer the service except where law expressly allows it.
- Process data you do not have authority or a lawful basis to use.
We may limit abusive traffic or suspend access needed to protect the service, merchants, customers or platform integrity.
5. Your data and responsibilities
You retain your rights in data submitted to or accessed through the service. You grant us the limited permission needed to process that data for the service, security, support and legal compliance.
You are responsible for verifying production outputs before manufacturing, engraving, fulfillment, credit action or other irreversible business steps. You are also responsible for protecting downloaded exports and configuring your source data.
Our Privacy Center describes our data practices. Product-specific privacy notices form part of these Terms where applicable.
6. Service changes and availability
We aim to keep paid services available and maintain core data correctness. We may change a service to improve security, comply with platform requirements or remove low-use features. Material changes will be communicated through reasonable means.
Services can depend on Shopify, hosting networks and other third parties outside our control. Scheduled maintenance, platform changes and unexpected outages can affect availability.
7. Disclaimers and limitation of liability
To the extent permitted by law, services are provided “as is” and “as available” without implied warranties of merchantability, fitness for a particular purpose or non-infringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
To the extent permitted by law, Mogibo and Moge App Lab will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost production, lost data or business interruption. Our aggregate liability relating to a paid service will not exceed the fees you paid for that service during the six months before the event giving rise to the claim.
8. Suspension, cancellation and termination
You can stop using a service or uninstall a Shopify app at any time. Cancellation and refunds, if any, follow the purchase screen and Shopify billing rules. We may suspend or terminate access for material breach, security risk, unlawful use or platform removal.
Terms that should logically survive—such as ownership, disclaimers, limits of liability and payment obligations—remain effective after termination.
9. Changes and governing terms
We may update these Terms and will post the revised effective date. Material changes affecting an active paid service will be communicated reasonably before they take effect when feasible. Continued use after the effective date means acceptance.
The law and forum specified on an applicable order or product listing control. If none is specified, the laws and courts of Moge App Lab’s principal place of business apply, without regard to conflict-of-law rules, subject to mandatory consumer rights.
